Terms & Conditions

The following Terms and Conditions of Service apply to all services provided by ShaCa Gurus™.

PROJECT ACCEPTANCE

At the time of proposal, ShaCa Gurus™ will provide the client with an estimate after completion of the initial consultation. Clients have 30 days to accept their estimate. After 30 days, the estimate expires and the client will need to request a new estimate of work. 

 

After the estimate is accepted by the client, ShaCa Gurus™ will provide the client with an invoice for the work. The client has 30 days to pay the deposit on their invoice to begin the work. After 30 days,  the invoice will expire and the client will need to request a new estimate of work.

TIMEFRAME & DELIVERY

Turnaround times are typically 4-6 weeks for basic websites (4 pages). The client will receive an invoice with a target time frame of project completion. This time frame is only guaranteed if the deposit is received within one week of acceptance and ALL required content is provided in a timely manner. If you have a specific deadline for your order please inquire about our rush service for an additional fee. If ShaCa Gurus™ is experiencing higher work volumes, your project will be scheduled for the soonest available time slot, and you will be notified at the earliest possible time. 

 

​ShaCa Gurus™ will provide concepts and 2 rounds of revisions to clients within the timeframes agreed upon in initial consultations. ShaCa Gurus™ has the right to refuse additional revisions.

 

The client will be provided with a finalized solution. Upon client approval, the remainder of the amount due will become payable. Payments may be made via PayPal or other previously agreed electronic funds transfer. Publication or release of work done by ShaCa Gurus™ on behalf of the client, may not take place before cleared funds have been received. Once payment has been made, the site will be published within 48 hours. There will be no reimbursement of funds unless agreed by ShaCa Gurus™.

 

SERVICE CHARGES

Charges for technical services to be provided by ShaCa Gurus™ will be set out in the written estimate or quotation that is provided to the client. At the time of the client’s acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% of the quoted fee will become immediately due. Work on the solution will not commence until ShaCa Gurus™ has received this amount. 

 

Hourly work will be rounded up to the nearest hour. Deposits for hourly work will be half of the total hourly estimate.

DOMAIN REGISTRATION 

Yearly registration costs are due immediately and need to be renewed at the end of the registration term. All costs are final. Reminders will be sent out 30, 15, and 2 days prior to the end of the registration term. Domains will become unreachable if they are not renewed by the end of the registration term. 

 

MAINTENANCE & HOSTING PLANS

Yearly and monthly service costs are due immediately and need to be renewed at the end of the service term. All costs are final. Reminders will be sent out 30, 15, and 2 days prior to the end of the service term. Yearly service plans will be terminated if they are not renewed within 15 days after the end of the service term. Monthly service plans will be terminated if they are not renewed within 5 days after the end of the service term. 

 

Service requests under the website maintenance plan do not include page layout rearrangements, page additions, or other website design changes or enhancements. They are limited to the maintenance and modifications of existing media and content for the website. Product, service, and blog updates are limited to 5 per month; unused monthly updates do not rollover to the next month. Content must be provided from the client for product, service, and blog updates. Monthly maintenance plans can be canceled at any time by emailing customerservice@shacagurus.com with your cancellation request.

LOGOS

Design-only, no printing services. All sales are final. We offer two free edits, with additional revisions available for a fee. If the final design isn't as envisioned, we can issue a credit for future use. Turnaround times are typically 5-7 business days but not guaranteed; inquire about rush service for deadlines. You have 3 business days after the design meeting to provide all necessary information; failure to do so results in completed work without refunds and a new purchase is required to complete the order. Describe your ideas clearly for smoother execution. Approved designs are sent in PNG format; other formats are available with a $50 conversion fee.  

 

WARRANTY

ShaCa Gurus™ provides a thirty (30) day warranty period from the day the website goes live to make sure the website meets the client’s originally agreed upon specifications. 

 

ShaCa Gurus™ does not guarantee that services provided and projects delivered will result in business growth or enhanced exposure for the client. SEO Optimizations are limited to the client’s site being indexed and visible through a specific Google search.

 

ABANDONED PROJECTS

A project shall be considered abandoned after 30 consecutive days have passed since the last productive communication received from the client. In all abandoned projects, deposits are forfeited without an option for reclamation. Any renewal of the project after termination will require a new agreement and deposit.

 

LIABILITY

The client agrees that ShaCa Gurus™ holds no responsibility for any changes made by any third party, before or after a website is delivered.

The client guarantees that they have legal rights to all elements of text, photographs, and anything else that they provide ShaCa Gurus™ with, and will not hold ShaCa Gurus™ responsible for any third-party claims.

ShaCa Gurus™ excludes itself from all and any liability from:

• Loss or damage caused by any inaccuracy;

• Loss or damage caused by omission;

• Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;

• Loss or damage to clients' artwork/photos, supplied for the site. Regardless of whether the loss or damage results from negligence or otherwise.

 

The entire liability of ShaCa Gurus™ to the client in respect of any claim whatsoever or breach of these terms and conditions, whether or not arising out of negligence, shall be limited to the charges paid for the services under these terms and conditions in respect of which the breach has arisen.

 

CONFIDENTIAL INFORMATION

During the completion of the project and afterward, ShaCa Gurus™ will use reasonable care to prevent the unauthorized use or dissemination of the client’s confidential information. Confidential information is limited to information clearly marked as confidential.

Confidential information does not include information that: ShaCa Gurus™ knew before the client disclosed it; is or becomes public knowledge through no fault of ShaCa Gurus™; ShaCa Gurus™ obtains from sources other than the client, who owe no duty of confidentiality to the client, or ShaCa Gurus™ develops independently.

 

ACCREDITATION AND PROMOTION

ShaCa Gurus™ is entitled to place accreditation, as a hyperlink, in the footer on each page of the final solution. ShaCa Gurus™ retains the right to reproduce, publish and display the solution on portfolios and websites, in galleries, design periodicals and other media or exhibits for the purposes of recognition of creative excellence or professional advancement, and to be credited with authorship of the works in connection with such uses.

 

Governing Law

These terms and conditions shall be governed by the laws of the State of Virginia.
